Agreement

By accessing BirthdaySong.app or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the service.

What we provide

BirthdaySong.app helps you create a personalised birthday song using information you provide and AI-assisted generation tools. We guide you through lyrics, pronunciation notes, review, and final song delivery.

Eligibility

You must be at least 18 years old, or have permission from a parent or guardian, to place an order. You are responsible for ensuring the information you provide is accurate and that you have the right to use any content you submit.

Your content and acceptable use

You are responsible for the stories, names, jokes, lyrics, photos, and other material you submit. You agree not to submit content that is unlawful, hateful, harassing, sexually explicit, defamatory, infringing, or otherwise inappropriate.

We may refuse, edit, cancel, or remove orders that violate these terms or create legal, safety, or platform risk.

AI-generated results

Song lyrics, audio, pronunciation suggestions, and cover art are generated with AI assistance. Results may vary, and we do not guarantee that every generated output will be perfect, commercially chart-ready, or accepted by third-party platforms.

Review and approval

Before final song generation begins, you will have the opportunity to review lyrics and pronunciation notes. Once you approve them, generation proceeds based on the approved content.

Payments

Prices are shown before checkout. Payments are processed by Stripe. By completing checkout, you authorise us to charge the displayed amount for the selected products or add-ons.

Revisions

Where revision options are offered for your order, they are provided as described during the purchase flow. Additional manual requests may be handled at our discretion.

Refunds

Because each song is custom-made, refunds are generally not available once final generation has started or delivery has been completed, except where required by law or explicitly stated for a specific product.

If you purchase the optional Spotify distribution add-on and distribution cannot be completed, we will refund that upgrade in full, as described at checkout.

Intellectual property

Upon full payment and delivery, you receive the rights needed to use your finished song for personal, non-commercial purposes such as sharing with friends and family, unless we state otherwise at purchase.

We retain rights in the BirthdaySong.app brand, website, workflows, and underlying service technology. You may not resell, sublicense, or commercially exploit the service itself.

Third-party services

Our service relies on third-party providers for payments, email, hosting, AI generation, and optional distribution. Their services may also be subject to separate terms and policies.

Disclaimer

BirthdaySong.app is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted service, error-free generation, or acceptance by third-party platforms.

Limitation of liability

To the fullest extent permitted by law, BirthdaySong.app and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the service.

Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Termination

We may suspend or terminate access to the service if you violate these terms or misuse the platform.

Changes

We may update these Terms of Service from time to time. Continued use of the service after changes are posted means you accept the updated terms.
